Participant Waiver and Release of Liability, Assumption of Risk, and Indemnity Agreement
By signing this Participant Waiver and Release of Liability, Assumption of Risk, and Indemnity Agreement (“Agreement”), I acknowledge and agree that I am over 18 years old, have read and understood this Agreement, and voluntarily agree to the following:
Definitions
“PFF” or the “League” means Pacific Flag Football LLC. “Released Parties” means collectively PFF and its owners, members, managers, officers, employees, contractors, officials, referees, volunteers, sponsors, advertisers, insurers, agents; any team organizers or captains; and the owners, lessors, and operators of fields, facilities, and equipment used for PFF activities; together with each of their affiliated entities, successors, and assigns.
Assumption of Risk
I understand that participation in flag football and related activities involves inherent risks, including, but not limited to, slips, falls, collisions, physical contact with other participants, weather conditions, equipment failure, and other known and unknown hazards that may result in serious bodily injury, permanent disability, illness, property damage, or death.
I voluntarily choose to participate in PFF activities and knowingly assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable.
Medical Fitness
I certify that I am at least twenty-one (21) years of age and physically capable of participating in PFF activities. I understand that it is my responsibility to consult with a physician regarding my ability to safely participate and that I participate entirely at my own risk.
Waiver and Release of Liability and Covenant Not to Sue
To the fullest extent permitted by California law, I voluntarily release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses of any kind, in law or equity, arising out of or relating to my participation in or attendance at PFF activities, including claims arising from ordinary negligence of any Released Party. I further covenant and agree not to sue or assert any claim against any Released Party for any matter subject to this release.
This release does not apply to claims arising from gross negligence, reckless conduct, or willful misconduct where such claims cannot legally be waived under applicable law.
Indemnification and Hold Harmless
I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, damages, liabilities, judgments, fines, penalties, costs, and expenses, including reasonable attorneys’ fees and costs, arising out of or related to my acts or omissions, my breach of League rules or this Agreement, my use of facilities or equipment, or claims brought by third parties related to my participation, except to the extent caused by the gross negligence or willful misconduct of a Released Party.
Medical Treatment
If I become injured or require medical attention during PFF activities, I authorize PFF to obtain emergency medical treatment on my behalf if I am unable to do so. I understand that I am solely responsible for all medical expenses incurred and that PFF assumes no responsibility for providing medical insurance or payment of medical costs.
Personal Property
I understand that I am solely responsible for my personal belongings. PFF shall not be responsible for the loss, theft, or damage of any personal property brought to League activities.
Rules and Code of Conduct
I acknowledge that I have read, understand, and agree to comply with the League Handbook, including all Rules, Policies, Terms and Conditions, Code of Conduct, and safety requirements. I understand that failure to comply may result in disciplinary action, suspension, or removal from PFF without refund.
Alcohol and Drug Policy
I acknowledge that PFF maintains a strict zero tolerance alcohol and drug policy. I agree not to participate in PFF activities while under the influence of alcohol or illegal drugs. I understand that participants displaying signs of intoxication or impairment may be removed from PFF activities and may forfeit eligibility for PFF provided insurance coverage to the extent permitted by applicable law. I further acknowledge that I may be held personally responsible for damages or injuries resulting from my conduct while impaired.
Media Release
I grant PFF permission to photograph, record, and use my name, likeness, image, voice, and participation in PFF activities for promotional, advertising, marketing, social media, and other lawful League purposes without compensation, subject to any written opt-out submitted to the League.
Severability
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force to the maximum extent permitted by law, and any invalid provision shall be enforced to the fullest extent possible consistent with applicable law.
Entire Agreement
This Agreement is in addition to, and does not limit, the League’s Terms and Conditions, which I have reviewed. In the event of any inconsistency, this Agreement shall be interpreted to provide the maximum legally permissible protection to the Released Parties while honoring California law.
Acknowledgment
I acknowledge that I have carefully read this Participation Waiver and Release of Liability, Assumption of Risk, and Indemnity Agreement in its entirety. I understand that by signing electronically, I am giving up certain legal rights, including the right to bring certain legal claims against Pacific Flag Football LLC and the Released Parties identified herein.
PFF reserves the right to modify, amend, or update this policy at any time. Participants will be notified of any material changes through the League’s official communication channels. Continued participation in PFF activities constitutes acceptance of any revised policy and/or waivers.
